Prague, 5th February 2024 – In 2021, the Czech company TollNet submitted the most favourable bid for the supply of an electronic toll collection system in Lithuania in the competition organized by AB Lietuvos automobiliu keliu direkcija (LAKD). However, during the additional scoring process, the company Proit was declared the winner, whose offer, according to TollNet,violated the terms of the tender.
After challenging the initial competition result in court by Proit, this company’s offer was later selected as the winning bid, despite the applicant providing the contracting authority with false, incomplete, and contradictory information about alleged experiences. This unfairly earned to this supplier additional points in the evaluation.
„The electronic toll system is a strategic infrastructure of the state. There is a risk in entrusting such a system to a company that provides false information in the tender and is on the list of unreliable suppliers due to significant discrepancies in fulfilling another public contract. Also, the supplier’s connection to the Russian Federation currently poses a direct threat to the national interests of Lithuania,“ stated Pavel Bednář, Chairman of the Board of TollNet.
TollNet, which has references from successful projects of electronic toll systems in the Czech Republic and Slovakia, as well as from building and operating electronic motorway vignette systems in Slovakia and Slovenia, welcomes the acceptance of the cassation appeal for further examination by the Supreme Court of Lithuania and the acceptance of the request for the application of preliminary protective measures in the form of suspension of the tender process and imposition of the obligation on the defendant (LAKD) not to conclude a contract.
